On July 22, 2009 the Newbury Township Zoning Commission (ZC) held their regular monthly meeting in the upstairs meeting room of Newbury Town Hall. Alice Munn called the meeting to order at 7:30 p.m. with Bill Skomrock Sr., Lou Tomsic and Carolyn Paschke present. The minutes of the May 27, 2009 were approved and signed. The regular June meeting had been cancelled.
Alice reported that there had been no BZA activity in the interim and that she planned to attend the upcoming BZA hearing on July 28, 2009.
The Zoning Amendment 2009-1 had been forwarded to the Trustees for their July 15, 2009 Public Hearing. Karen Endres reported on the discussions for modifications of Home Occupation Classes. The Trustees voted 2:1 to approve the 2009-1 zoning amendment with the modification to change internet sales to Class I Home Occupations with truck delivery restrictions. The 30 day waiting period would make the amendment effective August 14, 2009.
Alice Munn circulated the industry standards for definitions and regulations of electronic signs. Questions arose whether static displays were permissible and the 45 days limit on mobile signs. Alice suggested dividing up the electronic sign information with Lou Tomic researching definitions and Carolyn Paschke distance and message time.
Mr. Skomrock Sr. said some of these regulations are unenforceable and could lead to selective enforcement. The board consensus was that these regulations are useful tools to be used if needed.
Karen suggested having a representative from the sign company give a presentation to the commission possibly on a Saturday morning. Alice said she would schedule this and advise us when.
New business includes establishing a new setback distance for adult businesses - now set at 2-1/2 miles, not really defensible in court.
The next regular Zoning Commission meeting will be on August 26. 2009 at 7:15 p.m.
