On April 28, 2010 the Newbury Township Zoning Commission (ZC) held their regular monthly meeting in the upstairs meeting room of Newbury Town Hall. Carolyn Paschke called the meeting to order at 7:15 p.m. with Alice Munn, Jerry Hudak, Lou Tomsic and Judd Douglas present. She asked the board to welcome Steve Kitko - the newest alternate member (taking the place of Susan Walker-Meere). She reminded everyone that the meeting time had been changed to 7:00 p.m. The minutes of the February 24, 2010 were approved and signed. The March meeting had been cancelled due to the Easter holiday and spring break schedule conflicts.
Ms. Paschke stated that finalizing the sign code to include electronic signs would be the first order of business. Several definitions were changed and others added for mobile, hunting/trespassing and agricultural (production exempt from zoning but not sales) signs. David Snively concurred that flashing signs should be prohibited as too distracting; better err on the side of safety. Multiple ground signs for corner commercial lots were tabled for future consideration.
Alice Munn moved to accept the changes and close the code revisions on signs; Judd Douglas seconded the motion that passed by unanimous vote.
Karen Endres requested that discussion on wind turbines wait for another meeting when Sue Wagner can present her findings. Steve Kitko cited German laws that successfully addressed small turbines.
Karen Endres introduced a complaint from the Federal Dept. of Justice regarding unfair housing practices. Newbury’s Group home spacing was changed from 2.5 miles to 1.0 miles but still is not defensible. The 3 acre lot minimum is sound for water and septic. The All Erection Crane case is finally over – the State Supreme Court declined hearing the appeal and no motion to reconsider was filed. Changes on Sec. 5.02 A4 to add porches , patios, gazebos, uncovered steps and pavilions for permits was tabled for the next meeting.
The trustees are considering changing Grange Park from Active Park to Industrial requiring an adjustment to the Land Use Plan for best use. Other topics to consider: definition of restaurant, deli food service, taverns etc. with conditional use, no requirements for any business – see page 75.
The next regular meeting is scheduled for May 26, 2010 at 7:00 p.m.
