The regularly scheduled meeting of Newbury Township Trustees was called to order at 7:35 p.m., September 21, 2005, with all members present. Minutes of the previous meeting were approved as read upon a motion by Mr. Majeski, a second by Mr. Fioritto, and a unanimous vote.
Mr. Quigley asked Terry Aytay whether the township had an action plan in place for handling any crisis should it occur. He said he would contact the county, the sheriff and fire departments and report his findings. Fire activity reported by Mr. Fagan included 413 calls year-to-date, with 43 calls in September, somewhat over average.
Mr. Quigley asked Gerry Beaber and Janet Loftus to present their concerns about speeding on Rt. 44 particularly between Messenger and Bell roads. Mrs. Beaber cited accidents, hazardous driveway entry/exits and speeding trucks naming Universal Disposal, Haueter Sand & Gravel and Newbury Sand & Gravel as the worst offenders. Mrs. Loftus was concerned for school bus safety when speeding trucks can't or don't stop for flashing lights. They read a letter from Kim Sass, traffic supervisor for Newbury Schools in support of the children's safety issues. The sheriff's mobile electronic radar listed no vehicles going less than 60 mph in this 40 mph zone during a 20 minute monitoring period. They asked for a "target enforcement area" to enforce speed limits with extra police and sheriff patrols. The discussion continued regarding points on truckers licenses, enforcing speeding tickets when the 40 mph limit is not posted on the west side (ODOT responsibility), safety issues with "engine brake limits" and trustees' personal contact to alert trucking firms to correct drivers' speeding.
Mr. Majeski moved to adopt Resolution 20050921001, accepting the amounts and rates as determined by the Budget Commission and authorizing the necessary tax levies and certifying them to the County Auditor. Mr. Fioritto seconded this motion, which passed by unanimous vote.
Mr. Majeski moved to adopt Resolution 20050921002, the Issue 2 resolution for the joint project for paving and culvert work improvements on Snow Road. Mr. Fioritto seconded this motion, which passed by unanimous vote. Mr. Majeski moved to appoint Glen Quigley as the certified representative to the local transportation committee; Mr. Fioritto seconded this motion, which passed by unanimous vote. It was noted that Mr. Lair needs to certify the local funds; Mr. Quigley will follow up with Mr. Lair. Mr. Quigley will also complete the Capital Improvements Report with statements from the 04 master plan improvements by Mr. Hollis and Mr. Lair. The local share of the Snow Road improvements is estimated to be $32,000 plus a possible 10% overage if required.
Mr. Hollis reported the road department continued road patching, mowed cemeteries, completed headstone bases, and replaced the catch basins at the fire department with a pending invoice to the fire department, listing dollars spent. The discussion continued regarding the high cost of concrete paving and priorities, with the most used area being the driveway, versus the rear parking area, which is in the worst condition. No decisions were made on locations/costs of resetting road monuments at Lucky Bell and Munnberry Oval.
Mr. Quigley reported no response as of yet from the Prosecutor's Office regarding Sonny Battaglia's leave of absence request.
Ms. Endres submitted the Panzica Project site plan with final location of the retention pond pending. She is working with the architect and project manager to identify all variances needed for setbacks, parking spaces, and any others to be heard by the BZA at the same hearing. Mr. Quigley stated there would be considerable greenspace allowing for imaginative landscaping at the Auburn/87 NE corner. Ms. Endres took photos for further prosecutor action on the Roberta Ann property on Munn Rd. Some clean-up has been made but the property is far from being in compliance with the court order. Ms. Endres was asked to follow-up on a chop-shop business operating from the Great Lakes Cheese complex where unlicensed cars and vans are stored. Mr. Majeski cited the safety hazard of a "HOUSE FOR SALE" sign at eye level on the pole at the corner of Sperry Rd. & 87. Ms. Endres said she now has ODOT approval to remove such pole signs.
Health Care premium changes will be handled at a future date; Mr. Quigley will set up a date and time for each department to meet with a representative of the new plan to explain changes and answer any questions.
In other old business, review of available local and grant funds for the nature trail and zoning changes for active and passive park are still pending. It was reported that insurance will cover the of out-of-service police car until it is sold. It was decided to advertise it in the newspaper for $ 850 or best offer. The removal of equipment from this car is to be completed by next week. The title on an impounded Suzuki Samurai was transferred to the township for recovered property that could be utilized or sold. Mr. Majeski reminded the board of the old trailer on Blair's lot that should be scrapped or sold. Mr. Hess will complete platting of Center Cemetery grave sites. The exposed Adelphia cable problem has still not been resolved; it is scheduled for next week. Halloween will be observed on Monday October 31, 2005 from 5:30 to 7:30 pm, with extra vigilance by the Police requested. The All Erection Crane case is scheduled for December trial date before Judge Burt; new allegations were read that were similar to those previously dismissed by the federal court.
Mr. Quigley asked for support of State Issue #1 to sell bonds for financial assistance for businesses locating in Ohio. Mr. Fioritto moved and Mr. Majeski seconded the motion of support that passed by unanimous vote.
Mr. Quigley reviewed the qualifying discounts for Worker's Comp if the township has a representative at 8 safety meetings: the board approved the appointment of Mr. Hollis as the township representative.
Mr. Quigley reviewed the News-Herald article citing the reduced number and average sale price of homes and comparisons with various neighboring townships for 2004 and 2005, and questioning whether this was a trend or statistical anomaly. He will further research the basis for the stated 19% Newbury decrease. Mr. Majeski asked about the on-going asphalt zoning case for White Rd. in Burton Twp. Mr. Quigley reminded all that the court had denied Newbury's request to be a party in the Haueter case, and said that future White Rd. hearings will be monitored.
Correspondence was reviewed, and it was noted that a new gas well will be drilled on Ravenna Rd. Mr. Bush recommended that the sale of “fill-in” cemetery lots should be carefully monitored to avoid problems and retain future "reserved for family" spaces.
Mr. Aytay reported police activity at 54 calls to date with 1134 miles patrolled with 247 hours worked. He will post extra (not-on-duty) manpower on Ravenna Rd. in the identified target enforcement area and follow up with a 2 week synopsis of citations and warnings. This area will be #2 priority, after the school zones. He will speak to the trucking companies involved to ask for their cooperation and alert their drivers of this increased enforcement. Bill Skomrock advised recording the truck license number and time of day to identify speeding drivers.
